Charlotte Estate Planning Attorney Rose G. Proto

Have you been giving some thought to creating an estate plan? Perhaps you need to update your current documents?  Our office is happy to assist you, whether it's drafting a last will and testament or a revocable trust, we always aim to provide our clients with the resources they need to accomplish their goals.

We handle planning for retired individuals and provide advice on probate procedures, tax consequences and asset protection. We understand family dynamics and utilize careful planning strategies, including spendthrift provisions, to ensure distribution according to client wishes.  We advise on real estate matters, including deed transfers reserving a life estate, and offer assistance retitling assets for revocable trusts. Our estate planning includes  advisement pertaining to clients' individual assets, including bank accounts, individual retirement accounts (IRA), life insurance, certificates of deposit (CD), and managed accounts (mutual funds, brokerage accounts, etc.).  We also furnish guidance to clients on how to properly manage one's digital assets (electronic information, websites, content, passwords, social media, etc.) after death.

Our elder and special needs law practice is proficient in preparing special needs trusts, planning for families with disabled children, guardianship law, advance directives, living wills, health care power of attorney and end-of-life decision-making. We provide counsel regarding fiduciary duties (executors and trustees) and estate and trust procedures.  We understand that sometimes, our clients are not able to come to us, and we are happy to travel to elderly and disabled clients for meetings and document execution when the need arises.

We would be happy to meet with you to discuss your specific planning goals.  We are licensed to practice in North Carolina and New York.

We would ask that you complete our client questionnaire prior to our meeting.  It asks for a family tree as well as information about your assets and their location.  It will organize your information so that our meeting runs smoothly.

Please also bring any deeds, account statements, and current estate planning documents, including trusts and wills, in your possession.

You should be prepared to discuss any specific questions that you may have (it may help to write them down in advance). You should have a broad idea as to how you wish to distribute your assets upon your death.  This information will largely dictate the rest of the meeting.  I would also suggest that you identify an individual whom you trust to act as Executor. We may also discuss appointing an individual to serve as your agent with power of attorney, as well as someone to make medical treatment decisions for you if you can no longer do so.
